Agreement
By accessing or using this website, forms, and related online services (collectively, the “Site”), you agree to these Terms of Use and our Privacy policy. If you do not agree, please do not use the Site.
Who we are
The Site is operated by or on behalf of Perros de Baja (“we,” “us,” “our”). Contact: corey@perrosdebaja.com.
Permitted use
You may use the Site for lawful purposes only, including learning about our rescue work, applying to adopt or volunteer, donating, and contacting us. You agree not to: interfere with the Site’s operation; attempt unauthorized access to our systems or accounts; scrape or harvest data in bulk without permission; transmit malware; impersonate others; or use the Site to harass, defraud, or harm people or animals.
Donations and payments
Online donations may be processed through third-party platforms (for example GoFundMe, Venmo, or similar). Those transactions are governed by the third party’s terms and privacy policies. We do not control their systems. Receipts, chargebacks, and tax questions should be directed to the relevant processor when applicable.
Adoption, foster, and volunteer
Forms and communications through the Site do not create a binding adoption, foster, or employment contract until we (and, where required, you) complete any separate agreements or checks we require. We may decline or end a relationship when we determine it is in the best interest of people or animals in our care.
User content and submissions
If you submit stories, photos, testimonials, or other materials (“User content”), you represent that you have the rights to share them and that the information is truthful to the best of your knowledge. You grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and adapt User content in connection with our mission and fundraising (for example on the Site, social media, or print), unless we agree otherwise in writing. We may remove or moderate content at our discretion.
Intellectual property
The Site’s design, text, graphics, logos, and other materials we provide are owned by us or our licensors unless noted. You may not copy, modify, or exploit them for commercial purposes without prior written permission, except for fair use or sharing links to our pages.
Animal listings and medical information
Descriptions, photos, and behavioral notes are based on the best information we have at the time. They are not veterinary advice or a guarantee of health, temperament, or suitability for your home. Always consult your veterinarian for medical decisions.
Third-party links
The Site may link to social networks, payment providers, or other third-party sites. We are not responsible for their content, practices, or availability.
Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, uninterrupted, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, we and our volunteers, directors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or reliance on information on it. Our total liability for claims relating to the Site is limited to the greater of (a) amounts you paid us directly for services in the twelve months before the claim, if any, or (b) fifty U.S. dollars (USD $50), except where the law does not allow such a cap.
Indemnity
To the extent permitted by law, you agree to defend and indemnify us against claims arising from your misuse of the Site, your User content, or your violation of these terms.
Changes
We may update these terms by posting a revised version on this page. Continued use after changes become effective constitutes acceptance of the updated terms, to the extent allowed by law. For material changes, we may also post a notice on the Site or contact you when we have your details.
Governing law and disputes
These terms are governed by the laws that apply to our organization’s primary place of operations, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Courts or tribunals in that jurisdiction (or another forum we are required to use) may have exclusive jurisdiction over disputes, unless the law requires otherwise—your counsel should specify the right venue for Perros de Baja.
Severability
If any provision is found unenforceable, the remaining provisions stay in effect.
